Inquiry for conduct a online training course for 1 person on Open-Source Intelligence (OSINT), enabling knowledge of OSINT Gathering & Analysis operations, the use of programming languages in the OSINT, and the extraction of information from Dark Web, along with advanced image and video analysis.

Przedmiot zamówienia zostanie wykonany na potrzeby Instytutu Sieci Teleinformatycznych Politechniki Poznańskiej i w ramach projektu „Cyberbezpieczeństwo jako katalizator umiędzynarodowienia uczelni i rozwoju kadry”. Projekt ten jest realizowany w ramach programu Narodowej Agencji Wymiany Akademickiej SPINAKER – Intensywne Międzynarodowe Programy Kształcenia finansowanego ze środków Europejskiego Funduszu Społecznego w ramach Programu Operacyjnego Wiedza Edukacja Rozwój.

The subject of the contract will be conducted for the needs of the Institute of Information and Communication and Computer Networks at Poznan University of Technology as part of the "Cyber Security as a Catalyst for Internationalization of the University and Development of the Staff" project. The project is implemented as part of the Polish National Agency for Academic Exchange’s Programme SPINAKER – International Intensive Programmes  funded under European Social Fund and carried out under Operational Programme Knowledge Education Development.

      Celem zamówienia jest przeprowadzenie szkolenia online dla jednej osoby z zakresu białego wywiadu (rozpoznawania z ogólnodostępnych źródeł) umożliwiającego zdobycie wiedzy dotyczącej operacji OSINT Gathering & Analysis, wykorzystania języków programowania w procesie przeprowadzania białego wywiadu, a także pozyskiwania informacji z Dark Web, wraz z zaawansowaną analizą obrazu i wideo.

      The purpose of the contract is to conduct a online training course for 1 person on Open-Source Intelligence (OSINT), enabling knowledge of OSINT Gathering & Analysis operations, the use of programming languages in the OSINT, and the extraction of information from Dark Web, along with advanced image and video analysis.

      1. Kurs powinien być dostępny w ciągu 7 dni od podpisania umowy w formie dostępu na życzenie. / The course should be available within 7 days of thesignature of the contract in OnDemand type.
4. Wymagania dotyczące ośrodka realizującego szkolenie / Requirements for the training provider
   
   1. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy: / Contractors may participate in the contract award procedure who:
      1. znajdują się w sytuacji ekonomicznej i finansowej zapewniającej wykonanie zamówienia; / are in financial and economic situation that will allow the subject of the contract to be performer,
      2. posiada pełną zdolność do czynności prawnych lub korzystają z pełni praw publicznych;  / have full legal capacity or enjoys full public rights;
      3. są uprawnieni do wykonywania działalności określonej w zapytaniu ofertowym, jeżeli jest to wymagane przez prawo; / are entitled to perform the activities specified in the request for offers, if required by law;
      4. nie podlegają wykluczeniu z Postępowania o udzielenie zamówienia; / are not excluded from the contract award procedur;
   2. Wykonawcy, w celu potwierdzenia spełnienia warunków udziału w postępowaniu opisanych przez Zamawiającego, winni złożyć wymagane dokumenty  i oświadczenia: / Contractors, in order to confirm the fulfillment of the condition for participation in the contract award procedure described, shall submit the declarations and documents indicated below:
      
      1. wypełniony i podpisany przez Wykonawcę formularz ofertowy (wg wzoru stanowiącego Załącznik nr 1 do Zapytania ofertowego); / The “Offer Form” completed in accordance with the specimen and signed by the Contractor, which constitutes Appendix 1 of the Request for offers;
      2. oświadczenie Wykonawcy o spełnianiu wymagań wskazanych w rozdziale III i IV, (wg wzoru stanowiącego Załącznik nr 2 do Zapytania ofertowego); / A declaration of the compliance with the requirements indicated in Sections III,and IV of the Request for offers;
      3. oświadczenie o braku powiązań osobowych lub kapitałowych (wg wzoru stanowiącego Załącznik nr 3 do Zapytania ofertowego „Oświadczenie o braku powiązań kapitałowych lub osobowych”); / A declaration of no capital or personal links, which constitutes Appendix 3 of the Request for offers: “Declaration of no capital or personal links”;

Złożone oświadczenia i dokumenty powinny potwierdzać spełnienie warunków udziału w postępowaniu najpóźniej w dniu upływu terminu na złożenie oferty. / Submitted statements and documents should confirm that the conditions for the participation in the contract award procedure have been met for the date on the day of the deadline for the offer submission.
   4. Ocena spełnienia warunków udziału w postępowaniu będzie dokonana poprzez sprawdzenie czy złożone przez Wykonawcę dokumenty i oświadczenia potwierdzają spełnienie poszczególnych warunków udziału w postępowaniu, zgodnie z formułą „spełnia - nie spełnia”. Z załączonych dokumentów powinno wynikać w sposób jednoznaczny, że Wykonawca te warunki spełnia. / Assessment of compliance with the above conditions will be made in accordance with the formula “meets - does not meet”, based on information contained in the documents listed above. The content of the attached documents must clearly show that the abovementioned conditions are met by the Contractor.
   5. Niespełnienie chociażby jednego z ww. warunków skutkować będzie wykluczeniem Wykonawcy z postępowania. Wykluczenie Wykonawcy z postępowania może nastąpić na każdym etapie postępowania o udzielenie zamówienia. / Failure to meet even one of the abovementioned conditions will result in the Contractor’s exclusion from the procedure. The Contractor may be excluded from the procedure at any stage of the contract award procedure.
   6. Ofertę Wykonawcy wykluczonego uznaje się za odrzuconą. O wykluczeniu  z postępowania Zamawiający zawiadamia Wykonawcę, podając uzasadnienie wykluczenia. / An excluded Contractor’s offer shall be considered rejected. The Awarding Entity shall notify the Contractor about exclusion from the procedure, providing justification for the exclusion.
5. Podstawy wykluczenia z udziału w postępowaniu / Grounds for exclusion from the contract award procedurę
   
   1. postępowania  o udzielenie zamówienia wyklucza się Wykonawców, którzy: / Excluded from the contract award procedure shall be Contractors who:
      1. nie spełniają warunków udziału w postępowaniu określonych w Sekcji III i IV; / do not meet the conditions listed in Sections III and IV;
      2. nie spełniają warunków udziału w postępowaniu dotyczących przedłożenia wymaganej dokumentacji (oferta niekompletna); / do not meet the conditions for participation in the contract award procedure regarding the submission of the required documentation (incomplete offer);
      3. złożyli ofertę po terminie; / submitted an offer after the deadline;
      4. wyrządzili istotną szkodę zamawiającemu w okresie 3 lat (licząc od dnia upublicznienia zapytania ofertowego) poprzez nie wypełnienie uzgodnionego przedmiotu zamówienia lub wykonanie go bez należytej staranności; / caused material damage to the Awarding Entity over a period of 3 years (from the date of publication of the Request for offers) by not completing the agreed subject of the contract or executing it without due diligence;
      5. są poddani procesowi likwidacyjnemu; / are subject to the liquidation process;
      6. zostali prawnie skazani za przestępstwo popełnione w celu uzyskania korzyści finansowych (dotyczy osób fizycznych); / have been legally convicted of an offense committed for the purpose of obtaining financial gain (for natural persons);
      7. zostali skazani za uzyskanie korzyści finansowej z działalności przestępczej (osoby fizyczne, osoby prawne, pozostałe podmioty zdolne do wykonania przedmiotu zamówienia); / have been convicted of obtaining financial benefits from criminal activities (natural person, legal persons and other entities capable of performing the subject of the contract);
      8. wykonywali czynności bezpośrednio związane z przygotowaniem prowadzonego postępowania lub posługiwali się w celu sporządzenia oferty osobami uczestniczącymi w dokonywaniu tych czynności, chyba że udział tych Wykonawców nie utrudni uczciwej konkurencji; / performed activities directly related to the preparation of the contract award procedure or used to prepare the offer with persons participating in these activities, unless the participation of these contractors does not hinder the fair competition;
      9. złożyli nieprawdziwe informacje mające wpływ na wynik prowadzonego postępowania; / submitted false information affecting the outcome of the contract award procedur;
      10. podlegają wykluczeniu z postępowania na podstawie art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę i służących ochronie bezpieczeństwa narodowego (Dz. U. poz. 835). / subject to exclusion from the procedure pursuant to Art. 7 sec. 1 of the Act of April 13, 2022 on special solutions in the field of counteracting supporting aggression against Ukraine and serving the protection of national security (Journal of Laws, item 835).
   2. Z udziału w postępowaniu wykluczeni są Wykonawcy powiązani z Zamawiającym osobowo lub kapitałowo, przy czym przez powiazania kapitałowe lub osobowe rozumie się wzajemne powiązania między Zamawiającym lub osobami upoważnionymi do zaciągania zobowiązań w imieniu Zamawiającego lub osobami wykonującymi w imieniu Zamawiającego czynności związane z przeprowadzeniem procedury wyboru wykonawcy a Wykonawcą, polegające w szczególności na: / Contractors who have capital or personal links to the Awarding Entity shall also be excluded from participation in the contract award procedure; capital or personal links shall be understood as mutual ties between the Contractor and the Awarding Entity or persons authorized to incur obligations on behalf of the Awarding Entity, or persons performing any activities related to the contractor selection procedure on behalf of the Awarding Entity; such links shall in particular include:
      
      1. uczestniczeniu w spółce jako wspólnik spółki cywilnej lub spółki osobowej, / participation in the company in the capacity of a partner in a civil law company or partnership;
      2. posiadaniu co najmniej 10% udziałów lub akcji, o ile niższy próg nie wynika z przepisów prawa lub z przepisów dotyczących zasad realizacji projektu objętego Zapytaniem Ofertowym, / ownership of at least 10% of shares or stock, provided that a lower threshold is not mandated under legal regulations or rules concerning the principles of implementation of the project covered by the request for offers,
      3. pełnieniu funkcji członka organu nadzorczego lub zarządzającego, prokurenta, pełnomocnika, / holding the function of a member of a supervisory or management body, a commercial representative or an attorney;
      4. pozostawaniu w związku małżeńskim, w stosunku pokrewieństwa lub powinowactwa w linii prostej, pokrewieństwa drugiego stopnia lub powinowactwa drugiego stopnia w linii bocznej lub w stosunku przysposobienia, opieki lub kurateli, / being married to or having lineal consanguinity or direct affinity, collateral consanguinity or affinity to the second degree to, or being adopted by, or being under the guard or custody of such persons,
      5. lub jakiekolwiek inne powiązania mogące skutkować powstaniem konfliktu interesów przy udzieleniu zamówienia i naruszeniem zasady konkurencyjności. W przypadku ujawnienia się powiązań kapitałowych lub osobowych pomiędzy Wykonawcą a Zamawiającym, zamówienie nie może być Wykonawcy udzielone. / or any other relationships which may result in the conflict of interests while awarding the contract and in the violation of the competition principle. Should any capital or personal links be revealed between the Contractor and the Awarding Entity, the contract shall not be awarded to the Contractor.
6. Sposób przygotowania oferty / Offer preparation method
   
   1. Ofertę należy przygotować na formularzu stanowiącym Załącznik 1 do Zapytania Ofertowego „Formularz Oferty”. / The offer must be prepared using the form which constitutes Appendix 1 of the Request for offers - “Offer Form”.
   2. Treść złożonej oferty musi odpowiadać treści Zapytania Ofertowego oraz zawierać wszystkie wymagane załączniki wskazane w Rozdziale IX / The content of the submitted offer must be consistent with the Request for offers and it must include all of the required documents and declarations indicated in the Section IX
   3. Ofertę wraz z załącznikami należy złożyć w języku polskim lub w języku angielskim. / The Awarding Entity accepts submission of the offer, including all appendices in the Polish or English language.
   4. Wykonawca przed upływem terminu składania ofert może zmienić lub wycofać złożoną ofertę. / Before the expiration of the deadline for the offer submission, the Contractor may amend or withdraw the submitted offer.
   5. Cena podana w formularzu ofertowym powinna zawierać w sobie wszystkie koszty związane z realizacją przedmiotu zamówienia. Jeśli cena podana w ofercie będzie wyrażona w innej walucie niż złoty polski to zostanie ona przeliczona przy zastosowaniu średniego kursu sprzedaży ogłaszanego przez NBP, obowiązującego w ostatnim dniu składania ofert. / The price given in the offer form should include all costs related to the implementation of  the subject of the contract provided. If the price given in the offer is expressed in a currency other than the Polish zloty, it will be converted according to the average selling rate announced by the National Bank of Poland in force on last day for the submission of offers.
   6. Zamawiający zastrzega możliwość, w każdym czasie przed upływem terminu składania ofert, wprowadzenia zmian lub uzupełnienia Zapytania Ofertowego. / The Awarding Entity reserves the right to amend or supplement the Request for offers at any time before the lapse of the offer submission deadline.
   7. Zamawiający zastrzega sobie prawo do odwołania lub unieważnienia postępowania ofertowego w dowolnym terminie bez podania przyczyny. / The Awarding Entity reserves the right to recall or cancel the contract award procedure at any time without giving a reason.
   8. Wykonawca ponosi wszelkie koszty związane z przygotowaniem i złożeniem oferty. / The Contractor shall bear all the costs related to the preparation and submission of the offer.
7. Kryteria i sposób oceny oferty / Offer evaluation criteria and method
   
   1. Przy wyborze najkorzystniejszej oferty, Zamawiający kierować się będzie dwoma kryteriami oceny ofert tj.: Cena całkowita netto, biorąc pod uwagę cenę całkowitą za realizację przedmiotu zamówienia opisanego w Rozdz. II, III, IV, Zapytania Ofertowego na podstawie informacji przedstawionych przez Wykonawcę w Formularzu oferty stanowiąca 60% oceny oraz pokrycia przez przesłany przez Wykonawcę plan szkolenia wymagań dotyczących szkolenia opisanych w Rozdz. III stanowiący 40% oceny końcowej. /  In selection the best offer the Awarding Entity shall evaluate the “Net total price” criterion for the total gross prices of the subject of the contract descripted in Section II, III IV  on the basis of the information supplied by the Contractor in the Offer Form constituting 60% of the evaluation and the coverage by the training plan sent by the Contractor of the training requirements described in Chapter III constituting 40% of the final evaluation.
   2. Wartość punktowa w niniejszym kryterium zostanie obliczona w następujący sposób: / The score for this criterion shall be calculated as follows:

      

   3. Cena musi być podana w złotych polskich lub w innej walucie niż PLN. / The price shall be given in Polish zlotys (PLN) or any currency other than PLN.
   4. Cena musi być podana liczbowo, do dwóch miejsc po przecinku oraz słownie. / The price must be expressed numerically with the accuracy of up to two decimal places and in words.
   5. Podana cena musi obejmować wszystkie koszty realizacji zamówienia z uwzględnieniem wszystkich opłat i podatków (w tym od towarów i usług). W przypadku osób fizycznych realizujących przedmiot zamówienia na podstawie umowy cywilno-prawnej zawartej bezpośrednio z Zamawiającym, podana cena powinna uwzględniać całkowity koszt brutto umowy cywilno-prawnej oraz koszty jakie wystąpią po stronie pracodawcy z tytułu zawarcia i wykonania niniejszej umowy (jeśli dotyczy). / The price must include all the costs of the contract including all fees and taxes (including goods and services). In the case of natural persons performing the subject of the contract on the basis of a civil law contract concluded directly with the Awarding Entity, the total price should take into account the total gross cost of the civil law contract and the costs that will occur on the Awarding Entity's side for concluding and performing this contract (if applicable).
   6. Wszystkie inne koszty jakie poniesie Wykonawca przy realizacji zamówienia, a nie uwzględnione w cenie oferty nie będą przez Zamawiającego dodatkowo rozliczane. / Any other costs which have been incurred by the Contractor while completing the order and have not been included in the offer price will not be additionally covered by the Awarding Entity.
   7. Jeśli cena podana w ofercie będzie wyrażona w innej walucie niż złoty polski to zostanie ona przeliczona przy zastosowaniu średniego kursu sprzedaży ogłaszanego przez NBP, obowiązującego w ostatnim dniu składania ofert. / If the price given in the offer is expressed in a currency other than the Polish zloty, it will be converted according to the average selling rate announced by the National Bank of Poland in force on last day for the submission of offers
   8. Sylabus realizowanego szkolenia powinien być dołączony do oferty w formie załącznika i będzie podlegał ocenie w zakresie pokrycia tematyki kursu wskazanej w punkcie III b. przez Ogłoszeniodawcę / The syllabus of the training should be attached as an appendix to the offer and will be evaluated in terms of coverage of the course topics indicated in III b. by the Announcer
   9. O wyborze najkorzystniejszej oferty Zamawiający zawiadomi Wykonawców elektronicznie na adres e-mail, z którego została przesłana oferta lub na adres e-mail wskazany w ofercie. / The Awarding Entity will notify Contractors who have been awarded the contract electronically to the e-mail address from which the offer was sent or to the e-mail address indicated in the offer.
8. Miejsce, termin oraz sposób składania ofert / Offer submission place, date and method
   
   1. Oferta wraz z załącznikami powinna być przesłana za pośrednictwem poczty elektronicznej na adres: / The offer and attachments should be sent via e-mail to the address:
